O. P. (MD) No. 918/2021 dated 08.03.2021. Order :

This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.AL.GANDHIMATHI, Advocate for the petitioner and of Mr.P.KOTTAI CHAMY, Government Advocate(Crl.Side) on behalf of the Respondent, the Court made the following order:- This petition has been filed seeking extension of time for furnishing the sureties as directed by this Court in Crl.O.P.(MD) No.918 of 2021, dated 08.03.2021.

2. The learned counsel for the petitioner submits that this Court, while granting anticipatory bail, issued a direction to the petitioner to pay a sum of Rs.75,000/- to the defacto complainant Society. As per the order of this Court, the petitioner has taken a Demand Draft on 26.03.2021, but, the same was not accepted by the defacto complainant. Therefore, he filed a petition for extension of time in Crl.M.P.(MD)No.3508 of 2021. This Court, vide order dated 29.04.2021, granted a further time of two weeks. Thereafter, the defacto complainant Society received the Demand Draft only on 14.06.2021 and issued a receipt for the same. Subsequently, the petitioner has furnished sureties before the concerned Magistrate, but, the same was refused by the Magistrate on the ground of expiry of time limit. Hence, the present petition has been filed seeking extension of time to furnish the sureties. The petitioner, in order to show his bona fide, is ready to pay a sum of Rs.5,000/- to the Chief Minister's Relief Fund. https://hcservices.ecourts.gov.in/hcservices/ 1/2

Considering the submissions made by the learned counsel for the petitioner, this petition is allowed on condition that the petitioner shall pay a sum of Rs.5,000/- (Rupees five thousand only) to the credit of Government of Tamil Nadu, CMPRF in IOB, Secretariat Branch, Chennai-9 (Account No.11720 10000 00070, IFSC Code: IOBA0001172) and time is extended by ten days from the date of receipt of a copy of this order.
