Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of Writ of Mandamus, to direct the 2nd and 3rd respondents herein to release the illegally seized petitioner's property of 14 cents in Survey No.173/3B6 (totally 40 cents) under the Crime No.150 of 2022 of NDPS Act.

ORDER

The petitioner, with a grievance that the respondent Police has attached his property in C.C.No.150 of 2022 on the file of the Special Court for NDPS Cases, Madurai, has moved this petition seeking a direction to the respondent Police to de-link his property from the case in C.C.No.150 of 2022.

2. When this petition is taken up for hearing, the learned Additional Public Prosecutor submits that the petitioner's property is not the subject property in C.C.No.150 of 2022. However, it has wrongly been entered in the Sub Registrar Office and they undertook to release the petitioner's property from the encumbrance made before the Sub Registrar Office.
