Complainant PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the Judicial Magistrate Court No.I, Virudhunagar to dispose of the case in CC No.211 of 2020, within the time stipulated by this Court.

ORDER

This petition has been filed to direct the Judicial Magistrate Court No.I, Virudhunagar to dispose of the case in CC No.211 of 2020, within the time stipulated by this Court.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 3.When the matter is taken up for hearing, the learned counsel for the petitioner would submit that the crime is of the year 2017 and the money involved in the offence is more than Rs.5 Crores. The case has been registered for the offences punishable under Sections 406, 420, 506(I) IPC. The petitioner is a senior citizen and the prosecution has to examine huge number of witnesses to prove the charge against the accused and hence would pray for speedy disposal of the case.

4.The learned Additional Public Prosecutor would submit that except the fourth accused all other accused are appearing regularly. Due to lock down restrictions imposed by the Government, the trial is pending.

5.Considering the facts and circumstances of the case and the amount involved in the case and also taking note of the fact https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.9930 of 2021 that the oldness of the crime, there shall be a direction to the learned Judicial Magistrate No.I, Virudhunagar to expedite the process and complete the trial within six months from the date of receipt of a copy of this order. The compliance Report shall also be submitted to the Registry (Registrar-Judicial) of this Court. 6.With the above direction, this Criminal Original Petition is disposed of.
