2 W.P.(MD)NO.12558 OF 2021 Prayer: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 to remove the encroachment made by respondents 5 to 7 in the public well and tank(Urani) in S.F.No.86 and consequently direct the respondents 1 to 4 to excavate the illegally filled sand and debris from the public well and tank (water body) in S.F.No.86 in Thanjur Harijan Colony, Samuthiram Village No.110, Thirumayam Taluk, Pudukkottai District within a stipulated time as may be fixed by this Court by considering the representation dated 15.03.2021.

2. It is not in dispute that S.F.No.86, Thanjur Harijan Colony, Samuthiram Village has been classified as water body. 2/5

3. A construction was said to be illegally put up on a portion of the water body. Pursuant to the direction given by this Court, the illegal construction was removed. But consequential steps were not taken by the authorities. A mere look at the photographs enclosed in the typed set of papers would show that the portion of the water body has been filled with sand and levelled.
4. We direct the authorities to restore the water body to its original condition as expeditiously as possible. This writ petition stands allowed. No costs.
