ORDER
The petitioners are 1st and 2nd accused in S.C.No.199 of 2024 and they were found guilty and convicted and sentenced by the Principal District Court, Tenkasi, 1/3
by its Judgment dated 11.03.2025. Challenging the Judgment of conviction and sentence, the petitioners have preferred an appeal and also moved a petition in Crl.M.P.(MD)No.4025 of 2025 for suspension of sentence.
2. This Court, by its order dated 25.03.2025 in Crl.M.P.(MD)No.4025 of 2025, suspended the sentence imposed by the trial Court and directed the petitioners to report before the Thottiyam Police Station daily at 10.30 a.m. till the disposal of the appeal. Now, the petitioners have filed this petition to modify the said condition.
3. The learned counsel appearing for the petitioners submits that the first petitioner is the son-in-law of the second petitioner. Now, the marriage for the second petitioner's son is to be held on 18.05.2025. He has also furnished the marriage invitation. Therefore, he seeks to modify the said condition.
4. The learned Government Advocate (Crl. Side) appearing for the respondent Police submits that the petitioners are regularly complying with the condition from 30.03.2025.
5. Considering the fact that the petitioners are regularly complying with the condition from 30.03.2025, this Court is inclined to modify the condition imposed in Crl.M.P.(MD)No.4025 of 2025.
6. Accordingly, this petition is allowed and the condition is modified to the effect that the petitioners shall report the trial Court once in a month, i.e. on the first 2/3
working day of every English Calender month at 10.30 a.m., till the disposal of the appeal.
