Mr.P.Kottaichamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL UNDER SEC 438 OF CR.P.C. PRAYER :- For Anticipatory Bail in Crime No. 137 of 2024 on the file of the Respondent Police.

ORDER : The Court made the following order :- The respondent police registered a case as against the petitioners in Crime No.137 of 2024 for the offence under Sections 294(b), 323, 324, 448 and 506(i) I.P.C. Therefore, the petitioners have filed this petition seeking anticipatory bail. 1/3

2.The case of the prosecution is that the petitioners abused the defacto complainant by using filthy language and assaulted him with dire consequences and caused injuries 3.The learned counsel for the petitioners submits that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioners. 4.The learned Government Advocate (Criminal Side) appearing for the respondent strongly opposes to grant bail on the ground that the victim sustained head injury and still in hospital as inpatient. 5.Considering the serious objection raised by the respondent police and considering the fact that the victim sustained head injury with seven stitches and the victim is still in hospital, this Court is not inclined to grant anticipatory bail to the petitioners.

6.Accordingly, this Petition is dismissed.
