PRAYER in Crl.OP.(MD).No.7485 of 2026: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for the records in S.C.No.110 of 2025 in Crime No.42 of 2022 on the file of the Additional District and Sessions Judge, Pudukkottai and quash the same as against the petitioners concerned and thus render justice.

ORDER

This petition has been filed by the Accused Nos.1 to 9 in Spl. S.C.No.110 of 2025 on the file of the Additional District and Sessions Judge, Pudukottai, seeking to quash the charge sheet, wherein the accused persons are charged with offences under Sections 147, 148, 149, 294(b), 324, 307, 506(2) & 452 of IPC.

2. A perusal of the charge sheet reveals that the accused persons are alleged to have abused and attacked the defacto complainant with a wooden log, thereby causing injuries on the head of the defacto-complainant. A perusal of the medical records reveals that the injuries sustained are simple in nature. Therefore, Section 307 of the IPC is not attracted; rather, only Section 326 of the IPC would be applicable.

3. Pending trial, the parties have entered into a compromise, wherein, the defacto complainant has agreed for quashing of the charge sheet.

4. The defacto complainant is present in-person before this Court on 28.04.2026 and he acknowledged that he had agreed for quashing of charge sheet as against the petitioners.

5. Considering the above said facts, charge sheet in S.C.No.110 of 2025, pending on the file of the Additional District and Sessions Judge, Pudukottai is hereby quashed as against the petitioners.

6. Accordingly, this Criminal Original Petition stands allowed. The joint compromise memo shall form part and parcel of the order. 02.06.2026 2/2 NCC : Yes/No Index : Yes/No Internet: Yes/No gvn 3/4
