PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 and 2 to take appropriate action as against the Respondents 3 and 4 for the act of illegally sanctioned the subsidy amount and other benefits under the Scheme of PMAY (Pradhan Mantri Awas Yojana (Urban)) at Sampavar Vadakarai Town Panchayath in favour of the Respondents 5 to 23 by considering the petitioner's representation dated 07.07.2020 and 05.02.2023.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed the present writ petition seeking a direction to Respondents 1 and 2 to take appropriate action against Respondents 3 and 4 for allegedly illegally sanctioning subsidy amounts and other benefits under the scheme of PMAY (Pradhan Mantri Awas Yojana - Urban) at Sampavar Vadakarai Town Panchayat in favour of Respondents 5 to 23, by considering the petitioner's representations dated 07.07.2020 and 05.02.2023.

2.The grievance of the petitioner is that ineligible persons were granted subsidies under the PMAY (Urban) scheme as well as the Green House Scheme. In this regard, the petitioner submitted representations to the official respondents. Since no action was taken, the petitioner has filed the present writ petition.

3. The learned Additional Advocate General appearing for the 3/8

official respondents would submit that pursuant to the direction of this Court, enquiry has been conducted by the District Collector, Tenkasi and it is found only 8 ineligible persons were granted subsidy by the third respondent and four ineligible persons were granted subsidy by the fourth respondent and now one of the beneficiary has returned the subsidy amount and for recovery of the subsidy amount from the other ineligible persons, revenue recovery proceedings have already been issued by the District Collector, Tenkasi. He further submitted that disciplinary proceedings has also been issued against the erring officials.

The learned Additional Advocate General appearing for the official respondents submitted that, pursuant to the directions of this Court, an enquiry was conducted by the District Collector, Tenkasi. It was found that eight ineligible persons were granted subsidies by the third respondent and four ineligible persons by the fourth respondent. It was further submitted that one of the beneficiaries has already returned the subsidy amount, and revenue recovery proceedings have been initiated by the District Collector, Tenkasi, to recover the amounts from the remaining ineligible beneficiaries. He also submitted that disciplinary proceedings have been initiated against the erring officials. 4/8

5. In view of the above, since action has already been taken and recovery proceedings have been initiated by the first respondent, no further orders are required in this matter.
