Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, forbearing the respondents 4 and 5 from constructing Mannangadu Panchayat Building bearing in Survey No.159/8A and directed to construct the Panchayat Building in Survey No.150/4 as per the Mannangadu Panchayat Resolution Nos.4 and 5, dated 17.02.2020 at Mannangadu Village, Madukkur Panchayat Union, Pattukkottai Taluk, Thanjavur District and for other reliefs.

Heard both sides.

2. The petitioner is a ward member of Mannangadu Panchayat. The petitioner wants this Court to stop the authorities from constructing the Panchayat building in the petition mentioned land. In Survey No.159/8A, she wants the building to come up in Survey No.150/4 as per the earlier resolution dated 17.02.2020. The prime ground of attack is that the Panchayat building is 2/5

proposed to be put up in a land that was specifically donated for constructing a Library by one Ramachandran.

3. When the matter was taken up for hearing, the learned counsel for the respondents clarified that the said Ramachandran had executed one more settlement deed dated 28.06.2023 giving 2.6 cents in the very same survey number and that the Panchayat building will be put up in the said 2.6 cents and another survey number in S.No.159/6F. It is stated that 3 cents donated for Library purpose will not be diverted for any other use.

4. Recording the said stand of the respondents, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
