Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to issue a Writ of MANDAMUS, directing the respondents No.1 to 3 to cancel the mutation and patta granted to 3rd parties in respect of property belongs to 6th respondent Temple comprised in TD Nos. 2650 and 2035, S.No.550/2 having an extent of 3.01 Acres and S.No.550/3, having an extent of 9.88 Acres, Manapparai Village and Manapparai Taluk, Trichy District and further forebear the 4th respondent from registering any further documents in respect of above properties and pass such further or other orders as this Honble Court.

ORDER

The petitioner is the devotee of the sixth respondent's Temple. The grievance of the petitioner is that the lands belonging to the temple are being encumbered / alienate and therefore, he has been giving repeated representations to the official respondents to take action on any such illegal alienation / encumbrance.

2. I have heard Mr.R.Murali, learned counsel appearing for the petitioner, Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 to 5 and Mr.G.Mathavan, learned counsel appearing for the sixth respondent.

3. I have also gone through the representation that has been given by the petitioner that they are acting only in the interest of protecting the Temple property. In view of the above, the second respondent, the Revenue Divisional Officer is competent to consider the petitioner's representation dated 30.11.2024. However, I find that the said representation has not been made to the second respondent. Therefore, the sixth respondent shall forward the necessary papers along with a note 3/6

to the second respondent and the petitioner shall also forward his representation dated 30.11.2024 addressed to the Collector, within period of two weeks from the date of receipt of a copy of this order and on receipt of the same, the second respondent shall conduct due enquiry and dispose of the petitioner's application, on merits and in accordance with law, within a period of twelve weeks, thereafter.

4. With the above directions, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. Index : Yes / No NCC : Yes / No 28.04.2025 am 4/6
