ORDER : The Court made the following order :- The respondent police registered a case as against the petitioner in Crime No.333 of 2000 for the offence under Sections 147, 148, 149, 341, 294(b), 506(ii), 307 and 302 I.P.C and Section 4 of the Tamil Nadu Prohibition of Harassment of Women 1/3

Act. Therefore, the petitioner has filed this petition seeking anticipatory bail.

2. The case of the prosecution is that the petitioner and other accused have waylaid the deceased- Palani and one Sudhagar and brutally attacked and also criminally intimidated the others. Due to which, the deceased-Palani fell down with severe injuries and died on the spot and the said Sudhagar sustained severe injuries.

3. The learned counsel for the petitioner submits that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent strongly opposes to grant bail on the ground that the petitioner is a history sheeted rowdy, involved in 12 previous cases and this is a case of murder. Subsequent to this occurrence, the petitioner has also intimidated the other witnesses, for which, a separate case has been registered as against the petitioner. Earlier, the trial Court has granted anticipatory bail to the petitioner in Cr.M.P.No.698 of 2018 and the same was cancelled by this Court, by order dated 19.09.2023, in Crl.O.P.(MD)No.15224 of 2023.

5. Considering the serious objections raised by the learned Government Advocate (Crl.side) and also considering the antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this Petition is dismissed.
