O R D E R
[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted challenging the proceedings of the first respondent dated 05.04.2017 and to direct respondents 1 to 3 herein to remove all the encroachment made by the fourth respondent in Survey Nos.746, 17, J1, 191, 105, 10, 118 and F1405 of Pudupalayam Village, Rajapalayam Town and Survey No.285 of Samanthapuram Village, Rajapalayam Town and Survey No. 940A/2 of Ayan Kollenkondan Village, Rajapalayam Town, Virudhunagar District and restore the same.
2. The District Collector, Virudhunagar has filed an affidavit stating that as on date, there is no encroachment in the subject field. 2/4
He has further stated that survey has been conducted by the Revenue Authorities. The counter affidavit filed by the first respondent reveals about the survey numbers covered and that being so, no further adjudication is required in this Writ Petition. If any grievance exists regarding encroachment, the petitioner is at liberty to approach the authorities.
3. With the above liberty, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
