Respondents PRAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first and second respondents to pay and settle all terminal benefits viz GPF, DCRG, Pension Arrears, Commutation of Pension and Encashment on leave, together with interest at the rate of 18% per annum, with effect from 28.11.2023 by considering the petitioner's representation dated 16.09.2024.

Today, when the matter was taken up, it was brought to the notice of this Court that the petitioner had been paid all terminal benefits except the Deathcum-Retirement Gratuity (DCRG). However, it appears that there is a dispute

regarding the petitioner's entitlement in view of certain dues payable to the respondents.

2. Insofar as the DCRG is concerned, the same has not been released on the ground that certain amounts are due towards the housing loan availed by the petitioner. The outstanding housing loan amount is Rs.15,13,726/-, whereas the DCRG amount payable to the petitioner is Rs.13,33,333/-. 3.The learned counsel for the petitioner submitted that the petitioner has no objection to the adjustment of the DCRG amount towards the outstanding housing loan dues.

4. In view of the above submission, the respondents are at liberty to adjust the DCRG amount payable to the petitioner against the outstanding housing loan dues. Subject to such adjustment, all terminal benefits payable to the petitioner shall stand settled.

5. Accordingly, the writ petition stands closed. No costs. 10.06.2026 Index :
