ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police in C.C.No.9 of 2009 on the file of the learned Judicial Magistrate No.I, Kuzhithurai, Kanyakumari District for the offences punishable under Sections 294(b), 447, 427, 323 and 506(ii) I.P.C, seeks anticipatory bail.

2.The petitioner was absent during the trial in C.C.No.9 of 2009 before the learned Judicial Magistrate No.I, Kuzhithurai, Kanyakumari District. Therefore, Non-Bailable Warrant came to be issued on 12.02.2014.

3.The learned counsel appearing for the petitioner undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail.

4. Considering the undertaking given by the petitioner, the petitioner is permitted to appear before the learned Judicial Magistrate No.I, Kuzhithurai, Kanyakumari District on next hearing date and to file a petition to recall the NBW issued against him. The concerned Magistrate is directed to recall the warrant on the same day. If the petitioner fails to appear before the Court below on next hearing date, this order shall stand automatically cancelled.
