For Respondent : Mr.M.Vaikkam Karunanithi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 192 of 2024 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the 1/3
offences punishable under sections 387 and 506(ii) IPC in Crime No.152 of 2024 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner herein and other accused have threatened the defacto complainant with knife point and robbed a sum of Rs.19,00,000/- from him. Hence, a case has been registered.
3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.
4. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that totally 11 accused involved in this case and the A2 to A4 already arrested and still in custody. He would further submit that A1 is still absconding and the petitioner herien is arrayed as accused based on the confession of A2 and the investigation of the case is pending and the custodial interrogation of the petitioner is necessary and he strongly opposed to grant anticipatory bail to the petitioner.
5. Considering the serious nature of allegations made against the petitioner and also the submission made by the learned Government Advocate (Crl.Side) appearing for the respondent that the custodial interrogation of the petitioner is necessary, this Court is not inclined to grant anticipatory bail to the petitioner. 2/3
