O R D E R

This Writ Petition has been filed seeking to quash the impugned order passed by the 2nd Respondent in his proceedings in Na.Ka.No. 02-/epfH;/epuy;-K/fh/ep-KJit-2025, dated 18.04.2025 and consequently direct the second respondent to permit the petitioner to conduct Kabbadi Tournament from 25.04.2025 to 27.04.2025 during the festival of Sree Sembaludaiyar Ayyanar Kovil, Keelamanakarai village at Muthukulathur Taluk, Ramanathapuram District and provide adequate police protection. 2.The learned Counsel for the petitioner would submit that the petitioner is the President of the festival committee of the said temple. While so, the villagers decided to conduct festival for the above said temple from 25.04.2025 to 27.04.2025 and they also decided to conduct 2/6

Kabadi tournament from 25.04.2025 to 27.04.2025. Therefore, they approached the second respondent through the representation dated 18.04.2025, but the same has been rejected on the same day on the ground of law and order issue. The second respondent, without considering that the Kabadi is the one of the sports event, only based on the law and order issue, denied permission. Therefore, the impugned order is liable to be quashed.

3.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that the petitioner's representation was considered and rejected on the ground of law and order issue. The respondent police passed reasoned order, therefore, this petition is liable to be dismissed.

4.Heard both sides and perused the records.

5.The petitioner challenged the order passed by the second respondent by denying the permission for conducting Kabadi Tournament. The petitioner sent the representation to the second respondent for conducting Kabadi Tournament from 25.04.2025 to 3/6

27.04.2025 at Keelamanakarai village, Muthukulathur Taluk, Ramanathapuram District during the festival of Sree Sembaludaiyar Ayyanar Kovil, but the second respondent rejected the representation on the ground of law and order issue.

6.At this juncture, the learned Counsel for the petitioner brought to the notice of this Court that the petitioner is conducting Kabadi tournament for the past 27 years and no any untoward incident took place in the previous occasions. The petitioner also undertakes to conduct the tournament without any law and order issue. 7.In view of the above said undertaking, this Court is inclined to set aside the impugned order passed by the second respondent. Therefore, the impugned order is set aside and the second respondent is directed to grant permission for conducting kabadi tournament and using of loud speakers by imposing certain conditions. The petitioner is also directed to ensure that the programme has to conducted without any law and order issue.

8.With the above observations and direction, this Writ Petition is allowed.
