Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the first respondent to provide house sites patta to the residents of Ambedkar Nagar, Kottapattu, Tiruchirappalli District, within a time frame fixed by this Court as per the society representation dated 14.05.2021.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The relief sought for in the present Writ Petition is to direct the first respondent to provide house site pattas to the residents of Ambedkar Nagar, Kottapattu, Tiruchirappalli District, based on the society's representation dated 14.05.2021.

2.The High Court, in exercise of the powers of judicial review, cannot issue any direction to grant patta. Free house site pattas are to be granted under the Government welfare scheme by ascertaining eligibility and in consonance with the Revenue Standing Orders. However, a direction as such sought for by the petitioner's Society cannot be granted. 3.The learned counsel appearing for the second respondent/Airport Authority of India submitted that the said Government land has already been handed over to the Airports Authority of India for development of the Airports. Eviction proceedings have also been initiated and final orders have been passed.

4.In view of the above submissions, the relief to grant patta to the petitioner Sangam cannot be granted. The petitioner Sangam cannot claim patta as an absolute right, as it is subject to the eligibility and the scheme which is in force.

5.Accordingly, this Writ Petition is dismissed. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
