PRAYER:Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents herein to complete the work pertaining to the renovation works of the said temple namely, Arulmighu Brahmapureeswarar Kovil situated at Keelakorkkai Village, Kumbakonam Taluk, Thanjavur District as per the report of the Assistant Director of Archeological Department dated 12.10.2018 and thereby conduct the Kumbabhishekam of the temple within the time stipulated by this Court. (Order of the Court was made by J.NISHA BANU, J.) By consent, this writ petition is taken up for admission at the admission stage itself.
2.Mr.P.Thilak Kuamar, learned Government Pleader, takes notice for the respondents 1 to 2 and Mr.V.Chandrasekar, learned counsel takes notice for the fourth respondent.
3.The contention of the petitioner is that in the petitioner's village there is a temple called, Arulmigu Pushapavalli Sametha Brahmapureeswar Temple. 2/5
The said temple is under the control of the HR & CE Department. The authorities concerned have started to renovate the temple changing the cultural heritage violating the rules and regulations. Further, the funds sanctioned for renovation work was also misappropriated. Hence, the petitioner has submitted representations before the concerned authorities. However, no action has been taken. In the meanwhile, the respondents have decided to conduct Kumbabishekam in the said temple without completing renovation work. Hence, the petitioner has filed this writ petition 4.On perusing the entire affidavit and after hearing the submissions made by the petitioner, this Court is of the view that the contentions raised by the petitioner in this writ petition are general in nature and not supported by any materials. We are not inclined to entertain this writ petition. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
