PRAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents herein to prepare a fresh list of beneficiaries for allotment of free cows at Pattam Village, Tiruppuvanam Taluk, Sivagangai District, for distribution on 20.02.2019 on the basis of representation sent by the petitioner dated 05.02.2019.

O R D E R

[Order of the Court was made by The Hon'ble CHIEF JUSTICE] Heard Mr.V.Malaiyendran, learned counsel for the petitioner and Mr.P.Thilak Kumar, learned Government Pleader appearing for the respondents 1 and 2.

2. The present Writ Petition is filed in public interest.

3. It is submitted that drastic illegality is committed by the Officials in Free Milch Cows Distribution Scheme at Pattam Village,

Tiruppuvanam Taluk, Sivagangai District. The Government Officials who are authorised to select the beneficiaries are acting hand-in-glove with the Block Development Officer of Thiruppuvanam Taluk and prepared the list of beneficiaries of their own kith and kin leaving actual beneficiaries aside. According to the learned counsel, there are more than 25 persons who were not entitled for the benefit of the said scheme and or extended the said benefit. The petitioner has given the list of said persons.

4. Those persons are not parties to the Writ Petition. No adverse order can be passed in the absence of the parties.

5. The petitioner has already given a representation. The second respondent authority shall consider the said representation, shall verify the list of beneficiaries and shall verify the documents of the beneficiaries who have been given the benefit of Free Milch Cows Distribution Scheme - 2018-2019 at Tiruppuvanam Panchayat Union and upon verification, if it is found that some of them were not entitled to the benefit, shall take further action. The said exercise shall be completed within a period of six months from today.

6. With these observations and directions, the Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
