RESPONDENT/RESPONDENT IN BOTH PETITIONS Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to suspend the sentence of imprisonment imposed by the Learned I Additional District and Sessions Judge, Tirunelveli in Crl.A.No.17/2015 by the Judgement dated 05/01/2018 by which confirming the conviction and sentence of imprisonment imposed by the Learned District Munsif-cum-Judicial Magistrate, Sivagiri in C.C.No.7/2008 by the Judgement dated 17/02/2015 and enlarge the petitioner on bail pending disposal of the above Crl.R.C. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.DEENADHAYALAN, Advocate for the petitioner and of Mr.A.

ROBINSON Government Advocate Criminal Side in both side for the Respondents the court made the following order:- The Courts below find the petitioner guilty, as the petitioner has caused fatal accident to one person and caused injuries to two others. Though they have turned hostile, P.W.7 who has seen the occurrence has deposed in favour of the prosecution before the Trial Court and the Courts below have accepted it.

2. In the light of the above facts, this Court is not inclined to entertain Crl.M.P.(MD) No.6329 of 2018 filed for the suspension of imprisonment imposed on the petitioner and Crl.M.P.(MD)No.6330 of 2018 to exempt the petitioner from surrender. Therefore, both the criminal miscellaneous petitions filed in Crl.M.P.(MD) Nos.6329 & 6330 of 2018 are dismissed.

3. Registry is directed to post the main Criminal Revision Petition on 30.08.2018, for final disposal.
