ORDER : The Court made the following order :- Heard, the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

2.The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 324, 302 & 201 of IPC, in Crime No.166 of 2019 on the file of the respondent police, seeks anticipatory bail. 3.The petitioner's counsel states that final report has since been filed and therefore, the petitioner's case for Anticipatory Bail can be sympathetically and favourably considered. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.10613 of 2020 4.Since, this is a case arising under section 302 of IPC, I am of the view that is only the Court below that should take a call in the matter. Giving liberty to the petitioner to move the Court below, this Criminal Original Petition is dismissed. I make it clear that I have not gone into the merits of the matter. The disposal of this petition will not in any way cast any cloud on the petition to be filed before the court below. The petitioner has to necessarily surrender and take regular bail.
