PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus to call for the records pertaining to the impugned order in Na.Ka.No.55158/2015/MAVAPA1 dated 22.11.2018, on the file of the second respondent and the consequential impugned proceedings in Na.Ka.No.95/15-16/PA1 dated 14.12.2018, on the file of the third respondent and quash the same as illegal and to consequently issue a direction directing the first respondent to uphold and follow the legally fixed original seniority list as furnished by the third respondent in Na.Ka.No. 87/2009-10/Pa1, dated 11.03.2014, within a time frame to be fixed by this Court.

O R D E R

It is brought to the notice of this Court by the learned counsel appearing for the third respondent that subsequent to the filing of this writ petition, the promotion panel has, once again, been revised by the

respondents by following the decision rendered by the Honourable Supreme Court in the case of Bimlesh Tanwar vs. State of Haryana and others, reported in (2003) 5 SCC 604.

2. Learned counsel for the petitioners also agrees with the above submission made by the learned counsel appearing for the third respondent.

3. In view of the fact that the promotion panel has, once again, been revised subsequent to the filing of this writ petition, the prayer sought for in this writ petition has now become infructuous.

4. Accordingly, this writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed. 09.09.2024 NCC :
