For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL UNDER SECTION 438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1851 of 2020 on the file of the Respondent Police.

ORDER : The Court made the following order :- Apprehending arrest at the hands of the respondent police in Crime No.1851 of 2020 for the offences punishable under Sections 379 @ 379, 120-B, 406, 420, 465 and 468 of the Indian Penal Code, the petitioner has come up with the present petition seeking anticipatory bail under Section 438 of the Code of Criminal Procedure.

2. Heard both sides.

3. The petitioner is Accused No.1 in this case. The allegation is that, the car bearing Registration No.TN 58 AK 3519 originally owned by one Sathish Kumar, who said to have handed over the car to the petitioner herein, in lieu of receiving the loan amount to the tune of Rs.2,00,000/- [Rupees Two Lakhs only]. CRL.O.P.(MD). No.10176 of 2020 was sold to the defacto complainant by the petitioner. Subsequently, on enquiry, it was found that the number plate, registration number and chassis number of the vehicle have been changed by the petitioner. Hence, the complaint has been given.

4. Originally, the registration number of the vehicle is 'TN 58 AK 3519'. That was handed over by Sathish Kumar to the petitioner. Subsequently, the investigation reveals that the petitioner has changed the registration number using the registration number of a car which was completely damaged in an accident in Chennai and also changed the chassis number and thereafter, sold the car to the defacto complainant.

5. Now, it is stated that the petitioner is the man behind the entire occurrence and Accused No.2 was already arrested and now, is in custody. That apart, the petitioner is having two previous cases for the offence punishable under Section 420 of the Indian Penal Code. Since the petitioner being a habitual offender, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, the petition stands dismissed.
