The petitioner is a doctor. He has been implicated as one of the accused in Crime No. 9 of 2023, on the file of the first respondent police, for the offence punishable under Sections 420, 467, 468, 471 & 120B of IPC that he has issued Life Certificates of the Defacto complainant and her two daughters, without ascertaining their availability.
2.The case of the prosecution is that the properties of the defacto complainant have been sold by one Mohammed Arif and Sankara Balaji, based on a cancelled Power deed, which was earlier executed by the defacto complainant, in favour of the said Mohammed Arif. The said Sankara Balaji is the adjacent land owner of the defacto complainant. The role of the petitioner in the commission of offence is that being a doctor, he has issued Life certificates of the defacto complainant and her two daughters, for execution of the forged sale deed and registration, without the presence of the defacto complainant and her daughters.

3.The learned counsel appearing for the petitioner submits that the Life Certificates, which have been relied on by the complainant are not the certificates issued by the petitioner. It is in fact issued by forging his signature. Therefore, this petitioner has lodged a complaint as against one Mangayarkarasi and Praveen Raj that they have forged his signature and issued the fake certificates. The complaint of this petitioner was registered in Crime No.306 of 2024 on the file of Somarasampatti Police Station, for the offence under Sections 318(4), 336(3), 341(4) of BNS Act. Therefore, the learned counsel submits that this petitioner is an innocent and he has been unnecessarily added as an accused in Crime No.9 of 2023. Therefore, he prays to quash the First Information Report in Crime No.9 of 2023, insofar as this petitioner is concerned.
4.The learned Government Advocate (Crl.side) appearing for the respondent submits that the Life certificates have been issued by the petitioner without verifying the defacto complainant's presence and her daughters, for the purpose of execution of forged sale deed and 3/7
registration. Therefore, according to the learned Government Advocate (Crl.side), there are sufficient materials as against this petitioner and therefore, it is not a case for quash.
5.This Court considered the rival submissions and also perused the materials placed on record.
6.The petitioner claims that he has been implicated in Crime No.9 of 2023 that he has issued false Life Certificates. As per the contention of the learned Government Advocate, there are prima facie materials as against this petitioner. The only contention of the petitioner is that he has not issued the life certificates in dispute, for which, he has lodged a separate complaint and the same was registered in Crime No.306 of 2024, on the file of Somarasampatti Police Station, for the offence under Sections 318(4), 336(3), 341(4) of BNS Act as against one Mangayarkarasi and one another. 4/7
7.This Court is of the view that merely because a case has been registered on the complaint of this petitioner with regard the same issue, a case, which is pending as against him cannot be quashed. The grounds raised by this petitioner can also be considered and investigated by the respondent police. The Superintendent of Police, Trichy is directed to transfer the investigation in Crime No.306 of 2024 from the file of Somarasampatti Police Station to the respondent police or to some other investigating Officer and ensure that there is a common investigation in both the cases. At this stage of investigation, this Court is not inclined to quash the First Information Report. 8.Accordingly, this Criminal Original Petition is closed with the above directions. Consequently, connected Miscellaneous Petition is also closed.
