Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed by this Honourable Court on the petitioner to pay Rs.75,000/- (Rupees Seventy Five Thousand) to the credit of the District Mineral Foundation Trust, Tirunelveli forthwith.

Prayer in CRL MP(MD).7244/2022 :

To grant extension the time of the operation of the order in Crl.O.P.(MD0.No.1002/2022 dated 31.01.2022 on the file of this Honourable Court.

Order : These petitions coming up for orders on this day, upon perusing the petitions filed in support thereof and upon hearing the arguments of M/S.PALANI VELAYUTHAM S, Advocate for the petitioner in both petitions and of MR.M.VAIKKAM KARUNANITHI, Government Advocate (Crl.Side) on behalf of the Respondent in both petitions, the court made the following order:- This petition has been filed to modify the condition imposed by this Court in Crl.O.P(MD).No.1002 of 2022 dated 31.01.2022 that the petitioner shall pay a sum of Rs.75,000/-(Rupees Seventy Five Thousand only) to the credit of the District Mineral Foundation Trust, Tirunelveli.

2. The learned counsel for the petitioner submitted that the petitioner is not in a position to mobilize the fund within a time frame fixed by this Court.

3. Heard the learned Government Advocate(Crl.side) appearing for the respondent police.

4. On perusal of the records, it shows that this Court after considering the quantity of sand and hearing the both side arguments, imposed the above said condition. There is no reason to modify the said condition. Accordingly, this Criminal Miscellaneous Petition is dismissed and the time granted by this Court vide order dated 31.01.2022 in Crl.O.P(MD) No.1002 of 2022 is extended further for a period of three weeks from the date of receipt of copy of this order.
