Prayer: Writ Petition is filed under Article 226 of the Constitution of India, in the nature of a Writ of Mandamus, directing the respondents to settle the petitioner's benefit of encashment of Earned Leave (135 days) surrendered by petitioner before the respondents form the year 2010 to till the date of retirement of the petitioner with 6% interest.

O R D E R

The present Writ Petition has been filed by a retired Special Grade Driver of the respondent Corporation, seeking disbursement of the earned leave and surrender leave salary along with interest.

2. Though the petitioner has retired on 31.05.2023, the earned leave and surrender leave salary have not been disbursed to the writ petitioner, despite giving representation to the respondent on 12.02.2025, for disbursing the said benefits. Since the representation has not been considered, the present writ petition has been filed.

3. Heard the learned counsel appearing for the petitioner, the learned Special Government Pleader for the first respondent and the learned Standing Counsel appearing for the second respondent.

4. Considering the above said facts, the respondents herein are directed to release the eligible earned leave and surrender leave salary upon the writ petitioner along with interest at the rate of 6% p.a., from the due date till the date of disbursement, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said observations, this Writ Petition stands disposed of.

No costs.
