ORDER : The Court made the following order :- The petitioner/accused No.7, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379 of I.P.C., in Crime No.138 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 17.05.2021, at about 10.30 a.m., the defacto complainant while conducting patrol duty, 17 palm trees cut from the poramboke land in Survey No.117, situated at Thirali Bit II, Kadarampatti Village, Tirumangalam Taluk, Madurai District. The first accused entered into a sale agreement with one Srinivasan, who is an adjacent landowner of the said poramboke land. The first accused and eight others jointly cut and took away the palm trees.

3. The learned Government Advocate (Cri.Side) appearing for the respondent would submit that the respondent registered the F.I.R in Crime No.138 of 2021, in which, the petitioner was arraigned as Accused No.7. However, after completion of the investigation, the https://www.mhc.tn.gov.in/judis

respondent filed a final report only as against other accused persons deleting the petitioner's name. Therefore, no apprehension of arrest at the hands of the respondent.

4. Recording the said submission, this Criminal Original Petition is closed.
