ORDER : The Court Made the following order :- The petitioner/A1 apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120(b), 406 and 420 of I.P.C. in crime No.26 of 2018, seeks anticipatory bail.
2.The case of the prosecution is that when the defacto complainant's wife was on the look out for getting a Government job and preparing for recruitment tests, the petitioner along with the 2nd accused promised to secure her job either in the Indian Railways or in the Air Force and received a sum of Rs.10 lakhs and then heated them by not providing the employment. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.
4.The learned Government Advocate (criminal side) submitted that the investigation is pending and a huge amount has been involved in the crime and they have to recover the amount and opposed the grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner shall deposit a sum of Rs.5 lakhs to the credit of crime No.26 of 2018 on the file of the respondent police, before the Judicial Magistrate, Theni and on such deposit, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Theni and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m. for a period of two weeks and thereafter, as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stands dismissed.
