ORDER : The Court Made the following order :- The petitioner is in judicial custody since 27.07.2018 for the offences punishable under Sections 7 and 13 (2) r/w 13 (1) (d) of Prevention of Corruption Act, 1988, in Crime No.1 of 2018 on the file of the respondent police. He seeks bail. 2.The case of the prosecution is that on 23.07.2018, the defacto complainant approached the petitioner to pay the land tax for his vacant land in R.S.No.8/4 at extent of 1312.5 sq.feet. The petitioner demanded a sum of Rs.4,000/- as bribe for payment of tax to the tune of Rs.8,000/-. In this regard, the defacto complainant lodged a complaint and registered the same in Crime No.1 of 2018 for the above said offences.
3.The learned counsel for the petitioner would submit that the petitioner is a Tax Collector and did not commit any offence as alleged by the prosecution. He further submitted that the petitioner is in judicial custody from 27.07.2018 onwards. Hence, he prays for grant of bail to the petitioner. 4.Heard the learned Additional Public Prosecutor for the respondent.
5.Considering the above facts and circumstances and also considering the period of incarceration of the petitioner, this Court is inclined to grant bail to the petitioner. Accordingly, the https://hcservices.ecourts.gov.in/hcservices/
petitioner is ordered to be released on bail subject to the following conditions:
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Chief Judicial Magistrate, Special Judge, Ramanathapuram, (ii)the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders; sd/- 03/09/2018 / TRUE COPY / Sub-Assistant Registrar (C.S.)
