Prayer: Writ Petition is filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus directing the 1st respondent to dispose of the appeal pending in A.P.No.1 of 2018 before the first respondent within a stipulated time as fixed by this Court.

O R D E R

This Writ Petition has been filed in the nature of mandamus seeking a direction to the first respondent to dispose of an appeal in A.P.No.1 of 2018 within a stipulated time.

2. Notice has been directed to the third respondent and notice has been served and the learned counsel has entered appearance for the third respondent.

3. The learned Special Government Pleader appearing for the respondents 1 and 2 has filed a counter affidavit. It had been stated that the hearing of A.No.1 of 2018 commenced on 18.06.2018 and an Interlocutory Application was filed by the respondent in I.A.No.4 of 2018 and orders were also passed on 02.11.2018. It had been stated that the main appeal is pending before the revenue court.

4. A direction is issued to the first respondent to dispose of the appeal on or before 31.10.2023. Both the petitioner and the third respondent are 2/4

also directed to participate in the said appeal and not take unnecessary adjournments. They must facilitate to dispose of the appeal in A.P.No.1 of 2018 before the first respondent on or before 31.10.2023.

5. With the above direction, this Writ Petition is disposed of. No costs.
