P RAYER:
Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order dated 16.04.2025 passed by the 3rd respondent and quash the same as illegal and consequently direct the respondent no.1 to 4 to pass appropriate orders for the appointment of Jail Warder in the Tamil Nadu Uniformed Services Recruitment Board 2023 to the Petitioner (Enrolment Number 4000660) after fulfilling all formalities.

ORDER
This writ petition has been filed challenging the order passed by the third respondent dated 16.04.2025 with a consequential direction to the respondents 1 to 4 to pass appropriate orders for the appointment of Jail Warder in the Tamil Nadu Uniformed Services Recruitment Board 2023 to the Petitioner (Enrolment Number 4000660) after fulfilling all formalities.

2. Heard the learned counsel on either side and perused the materials placed before this Court.

The petitioner applied for joint recruitment to the posts of Grade II Constable, Grade II Jail Warden and Fireman of Police and he successfully cleared the written examination and secured 65 marks out of 70 marks and thereafter, the petitioner called for physical measurement test, which also he succeeded and participated in the subsequent sports events. Finally, he secured 90 marks and his name was mentioned in the selection list for the post of Jail Warden. The petitioner was asked to appear for certificate verification. and he also appeared for certificate verification. Pursuant to the same, he was also asked to appear for medical examination at Usilampattai Government Hospital, Madurai, wherein the petitioner underwent echo test. He was also referred to the Medical Board at Madurai Government Hospital.
However, the petitioner was not called for training, whereas other candidates were called for training. While this being so, the impugned order came to be passed stating that the petitioner is unfit for this job on cardiac status. Challenging the same, this writ petition came to be filed.

The learned counsel appearing for the petitioner would submit that as per the recruitment rules, only the sound health persons are entitled to participate in this recruitment process and as per the same, only the medical board has to ascertain whether the petitioner is sound health or not. He also relied upon an order of this Court dealing with a similar issue in WP(MD)No.14228 of 2010 dated 24.09.2014, which was allowed by this Court and hence, he prayed for allowing this writ petition.

Per contra, the learned Additional Advocate General appearing for the respondents would submit that Usilampattai Government Hospital, Madurai and Madurai Government Hospital conducted medical examination in respect of the petitioner and he was medically examined and he is stated to be unfit for this job on account of his cardiac status. He would also submit that pursuant to the order of this Court, the petitioner was also medically examined by the Regional Medical Board Rajiv Gandhi Government General Hospital, Chennai on 22.08.2025 and it was opined that in view of cardiac status, he is not fit for recruitment to the post of jail warden.

6. Admittedly, the petitioner was selected for the recruitment to the post of Jail Warden. However, he is medically not fit for the said post, pursuant to the medical examination conducted both by Usilampatti Government Hospital, Madurai. He was further referred to the Regional Medical Board Rajiv Gandhi Government General Hospital, Chennai on 22.08.2025 and its opinion reads as follows:- 'in view of cardiac status, patient is not fit for recruitment as jail warden'.
7. In view of the expert opinion opined by the Regional Medical Board Rajiv Gandhi Government General Hospital, Chennai, the petitioner is not fit for the recruitment to the post of Jail Warden. This Court is not an expert to conclude whether the petitioner is medically fit or not. It is for the expert to do the same. In the present case, there are three experts having opined that the petitioner is not fit for the post of Jail Warden. Further, the case relied upon by the learned counsel appearing for the petitioner is not applicable to the case on hand. In the present case, there are three expert opinions in respect of the petitioner's 5/8
unfitness for the post of Jail Warden and hence, the petitioner is not entitled for the prayer sought in this writ petition.
8. In view of the above observations, this writ petition stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
