to 4 herein to survey and to earmark the four boundaries as per the petitioner's application No.2025/0178/24/000082 dated 18.02.2025 in respect of the petitioner's property comprising of 6.75 cents (2941 sq.ft) in bearing Town Survey No.20/1 (Old R.S.No.111/2G2E) situated at Block No.0005, Ward No.12, Thaththaneri, Madurai North Taluk, Madurai District on the basis of sale deed in Doc.No. 1915 of 2013 dated 03.04.2013 on the file of Chokkikulam Sub Registrar office, Madurai District and consequently directing the second respondent to grant separate patta to an extent of 6.75 cents in the name of petitioner on the basis of outcome of survey report of the third and fourth respondents by considering the petitioner's representation dated 11.04.2025.

O R D E R

The petitioner seeks issuance of a Writ of Mandamus directing the respondents to survey and demarcate the four boundaries based on the petitioner's application dated 18.02.2025 and consequently, direct the second respondent to issue separate patta to an extent of 6.75 cents in the name of the petitioner. 2/5

2.The prayer sought for is two fold. Firstly, the petitioner seeks survey to identify the four boundaries and rectify the mistake with regard to the extent of the property. Secondly, the petitioner seeks a consequential direction to the second respondent to issue separate patta for the larger extent in the name of the petitioner. The second prayer shall be subject to the outcome of the survey to be conducted by the respondents 3 and 4.

3.In the light of the above, the Writ Petition is disposed of, directing the respondents 3 and 4 to pass orders on the application for survey dated 18.02.2025, after giving notice to the petitioner and after hearing the objections, if any of the fifth respondent. The said exercise shall be carried out within a period of twelve [12] weeks from the date of receipt of a copy of this order. Subject to the entitlement of the petitioner to correction namely, the larger extent of 6.75 cents, then the second respondent shall pass orders regarding issuance of separate patta within a period of four [4] weeks, thereafter.
