PRAYER :- For Bail in Crime No. 973 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner herein was arrested and remanded to judicial custody on 14.08.2020 for the alleged offences under Sections 147,148,341,294(b),352,302 of IPC.
2. There are totally 13 accused in this case and the petitioner herein is arrayed as A9. The case of the prosecution is that there is a previous enmity between A1 and the deceased while conducting political meeting and mediation was conducted. Thereafter in wreck vengeance all the accused said to have conspired together on the date of occurrence and when the deceased was going in a two wheeler this petitioner along with other accused way laid him and some of the accused said to have attacked the deceased with dangerous weapons and caused his death. Hence the complaint.
3. The learned counsel for the petitioner would submit that the name of the petitioner does not found place in the First Information https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.10233 of 2020 Report and he has been falsely implicated in this case. He would also submit that the petitioner is in jail from 14.08.2020, hence he may be granted bail.
4. The learned Government Advocate(Criminal Side) would submit that all the thirteen accused conspired together and committed murder of the deceased. He would also submit that specific overt act has been attributed against this petitioner. Investigation is still pending.
5. Taking into consideration the gravity of offence and the role played by the petitioner and also the fact that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
6. Hence this petition stands dismissed.
