To set aside the order dated 01.12.2016 passed by this Hon`ble Court in W.P(MD)No.360 of 2010 and dismiss the writ petition and thus render justice.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.M.E.ILANGO, Advocate for the petitioner and of Mr.H.THAYUMANASWAMY, Advocate on behalf of the Respondent, the court made the following order:- [Order of the Court was made by M.M.SUNDRESH, J.] The present Miscellaneous Petition seeking to condone the delay of 401 days in filing the appeal is allowed, subject to the condition that the appellant shall pay a sum of Rs.3,000/- [Rupees Three Thousand only] to the learned counsel appearing for the second respondent, on or before 14.09.2018. It is made clear that if the payment is not made within the time stipulated in this order, this petition shall stand dismissed automatically without further reference to this Court.
