Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Sections 206, 120(b), 207, 261, 409, 418, 424, 434, 462 and 477 I.P.C. in Crime No.13 of 2015, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner while working as a Sub-Registrar in the office of the Sub-Registrar, Ramanathapuram, he destroyed the documents pertaining to Surai Kottai Village, comprised in Survey No.215/3. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner has filed a quash petition before this Court in Crl.O.P(MD).No.4703 of 2015 to quash the first information report in Crime No.13 of 2015 and this Court was pleased to grant an order of interim stay on 17.03.2015. Even after the receipt of the order copy, the respondent police laid a charge sheet and the same was taken cognizance by the learned Judicial Magistrate No.II, Ramanathapuram in C.C.No.53 of 2018. Hence, he prays for anticipatory bail to the petitioner.

5.It is seen that the petitioner had approached this Court and obtained an order of stay. However, the respondent laid a charge sheet and the same was taken on file. Now, the trial is pending before the learned Judicial Magistrate No.II, Ramanathapuram. 6.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Ramanathapuram and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. 7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
