PRAYER :- For Bail in Crime No.115/2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 09.03.2023 for the offences under Sections 294(b), 307 and 109 of IPC in Crime No.115 of 2023 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that in continuation to the property dispute on 08.03.2023 at about 09.30 a.m., the husband of the de-facto complainant received a phone call that somebody is trying to make tin shed in place belonging to him, hence, he rushed o the spot. On the same day at about 10.30 a.m., the de-facto complainant received a phone call that her husband was stabbed and she rushed to the hospital and came to know the fact from her husband that on the instigation of A1, A2 to A4 who are working under A1 with an intention to cause death attacked the injured with https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.8351 of 2023 knife on his right side chest and also attacked him on his left chest and left side hip and caused injuries. Hence, the case. 3.Heard. Perused the materials available on record including the First Information Report.
4.This is the second application for bail and the earlier application for bail was dismissed by this Court on 19.04.2023 in Crl.O.P(MD) No.6808 of 2023 and there is no change in circumstances of the case to consider the present bail petition even after dismissal of the petition. Hence, this court is not inclined to grant bail to the petitioner.
