For Respondent : Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Cr.No.646/2022 on the file of the respondent police ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323, 447 and 506(2) I.P.C, in Crime No.646 of 2022 on the file of the respondent police, seeks anticipatory bail. 2.Reading of the First Information Report shows that on 10.06.2022, after temple festival, when the defacto complainant was returning, there was trouble between himself and the accused persons. That matter was compromised. Later, on the same day at about 03.30 pm., the petitioner along with co-accused have trespassed into the house of the defacto complainant, assaulted and also criminally intimidated him.
3.The learned Government Advocate (Crl.side) for the respondent submits that the defacto complainant was in serious condition and was admitted in the hospital and later discharged from the hospital on 12.06.2022, after treatment. He would further submit that the petitioner is a history-sheeter (Rowdy Person) and is also having two previous cases, among which one is under the provisions of NDPS Act and another is under the provisions of IPC. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.10890 of 2022 4.The learned counsel for the petitioner submitted that the petitioner is a physically challenged person and he is also ready to produce the documentary evidence in that regard. 5.However, considering the bad antecedents of the petitioner, he is not entitled for the discretionary relief of anticipatory bail. This petition deserves to be dismissed and accordingly, dismissed.
