Respondent/Respondent/Plaintiff Prayer :This Second Appeal is filed under Section 100 of Civil Procedure Code, to set aside the judgment and decree of the Lower Appellate Court dated 24.06.2014 passed in A.S.No.57 of 2013 on the file of the Principal District Judge, Tirunelveli, confirming the judgment and decree of the Trial Court dated 17.04.2012 passed in O.S.No.375 of 2010 on the file of the II Additional Subordinate Court, Tirunelveli and to allow the Second Appeal. JUDGMENT

Heard the learned counsel appearing for the appellant and the learned counsel appearing for the respondent. 2.On the side of the appellant an undertaking affidavit is filed that the appellant is willing to pay the entire decreetal amount within a period of six months.

3.On the side of the respondent, it is stated that four months time may be granted to the appellant for payment. 4.Records Perused.

5.The appellant is directed to pay a sum of Rs.1,00,000/- (Rupees One Lakh Only) on or before 17.09.2018 and another sum of Rs.1,00,000/-(Rupees One Lakh Only) on or before 12.11.2018 and the balance amount on or before 17.12.2018. https://hcservices.ecourts.gov.in/hcservices/

6.With the above directions, this Second Appeal is disposed of. No costs. Consequently, the connected Miscellaneous Petition is also closed.
