This Civil Miscellaneous Petition filed under order 41 Rule 19 r/w. Sect.151 of CPC is filed to set aside the order passed S.A. No.1750 of 2022 dated 24.11.2021 and restore the second Appeal. ORDER:- This Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.K.C.Ramalingam, Advocate for the Petitioner and of Mr.V.Ramakrishnan, Advocate for second to fifth respondents, this Court made the following order:

This Civil Miscellaneous Petition has been filed to set aside the order passed by this Court in SA.No.1750 of 2002 dated 24.11.2021 and restore the same.

2. Having satisfied with the reason assigned in the affidavit filed in support of this petition, this restoration petition is allowed.

No.169 of 1999 dated 08.11.2001 on the file of the Principal District Judge, Madurai by restoring the judgment and decree in O.S. No.205 of 1997 on the file of the District Munsif, Madurai Taluk dated 18.01.1999. DECREE:- This Second Appeal coming on for hearing on this date, upon perusing the grounds of Appeal, the judgments and decrees of the Lower Appellate Court and the Court of First Instance and the material papers in the Suit and upon hearing the arguments of Mr.K.C.RAMALINGAM, Advocate for the Appellant and of Mr.V.RAMAKRISHNAN, Advocate for the respondents, this Court doth order and decree as follows:-

(1) That the Judgment and Decree in A.S. No.169 of 1999 dated 08.11.2001 on the file of the Principal District Judge, Madurai in sofar as the portion of CEFD in the plaint plan abutting the appellant's northern wall to the extent of 5 inches North-South and 23 fts., East-West is set aside and the Second Appeal is partly allowed.

(2) That the respondent be and is hereby entitled to a declaration, permanent injunction and Mandatory injunction as prayed

for in plaint CEFD portion to the extent of 1.1. ft., North South and 23 fts., East-West, abutting his southern wall.
