PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for the records relating to the P.R.C.No.13/2025 on the file of the learned Judicial Magistrate, Thirumayam in crime No.50/2022 dated 04.04.2022 and Quash the same as against this petitioner alone by allowing this Criminal Original Petition.

ORDER

The present petition has been filed by the petitioner/A5 in PRC.No.13 of 2025 on the file of the learned Judicial Magistrate, Thirumayam, seeking to quash the charge sheet, wherein, the petitioner charged with the offences punishable under Sections 306, 147, 294(b) & 149 of IPC r/w Section 4(B)(2) of TNPHW Act, 2002.

2. A perusal of the charge sheet reveals that the petitioner, along with others, are said to have abused one Nalli @ Lalitha about her fidelity and said that she can commit suicide and abused her. Thereafter, the deceased committed suicide and passed away and FIR came to be registered on 04.04.2022 in Crime No.50 of 2022.

According to the petitioner, there is no nexus between the petitioners and the deceased person, and they are not connected with the family of the deceased person at all, and no proximity or immediate connection has been established with the alleged incident, and Section 306 of IPC would not get attracted. He further relied upon Section 161 Cr.P.C statements of some of the witnesses in support of the said contention.

4. This Court carefully perused the charge sheet and the submissions made on the either side.

5. A perusal of the FIR clearly reveals that prima facie allegation have been made as against the petitioner/A5. As far as the other contentions raised by the learned counsel for the petitioner are concerned, they are subject matter of trial as to whether there is any proximity with regard to the alleged incident and the death of the deceased person. In the said circumstances, there are no other legal grounds and this Court does not find any merit in the petition.

6. The personal appearance of the petitioner/A5 in S.C.No.141 of 2026 on the file of the Mahila Court, Pudukottai is dispensed with unless it is specifically directed by the trial court.

7. Accordingly, this Criminal Original Petition stands dismissed leaving open all the submissions raised during trial. Consequently, connected miscellaneous petitions are closed.
