PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the official respondents 1 to 4 to take necessary and immediate actions in accordance with law upon considering the petitioner's representation dated 19.02.2025 in order to remove the encroachments made in the public pathway in survey No.151 of Vaiyampatty Village, Manapparai Taluk, Tiruchirappalli District, within time frame to be fixed by this Court.

O R D E R
[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted seeking a direction to the respondents to take necessary and immediate actions in accordance with law by considering the petitioner's representation dated 19.02.2025 for removal of encroachments made in the public pathway in Survey No.151 of Vaiyampatty Village, Manapparai Taluk, Tiruchirappalli District, within time frame to be fixed by this Court.
2. Today, when the matter is taken up for hearing, learned Special Government Pleader appearing for the respondents produced a typed set of papers, wherein a copy of the report of the Revenue Inspector has been annexed, which reveals that Survey No.151/1 of Vaiyampatti Village is classified as "Government Poramboke" and from the remarks column of the said report, it is seen that the subject land has been allotted to the Police Department. Further, it is submitted that the authorities concerned found no encroachment in the subject land. However, the petitioner has encroached upon a portion in Survey No.151/1, to an extent of 27 square meter. In this regard, the authorities concerned have initiated necessary enforcement actions and a notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905, has been issued to the petitioner and the petitioner has to respond to the said notice and thereafter, a final decision will be taken.

Insofar as the present writ petition is concerned, the authorities concerned have found that except the encroachment made by the petitioner, there is no encroachment in the subject land and for removal of the encroachment made by petitioner, necessary action has already been initiated. That being so, no further consideration is required in this writ petition.
