3.The Deputy Director, Fisherman and Fisheries Welfare Department, Zonal Office of the Joint Director of Fisheries, 4.The Assistant Director, Zonal Office of the Deputy Director of Fisheries, ... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the second respondent 1/4

to provide National Sea Fisherman / Fisherman Savings and Relief fund of Rs.4,500/- which is provided on behalf of the National Sea Fisherman and Fisheries Department for the period from the year 2020 along with the interest and for future days by considering the petitioner's representation dated 04.06.2022 For Petitioner : Mr.S.M.A.Jinnah For Respondents : Mr.M.Prakash Additional Government Pleader

ORDER

Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.

2. The petitioner seeks disbursement of the relief fund payable to every member of the subject society from the year 2020 onwards. No doubt, there is a scheme as claimed by the writ petitioner. The benefit of the scheme will be available only for those members who have paid the contribution. According to the respondents, due to some dispute between the petitioner and the management of the fishery society, contribution was not remitted.

3. The petitioner's counsel would state that the petitioner was always ready to pay the contribution. But the vice president of the society did not 2/4

receive the same. This is a factual aspect and this Court cannot go into the same. The respondents cannot be blamed for not disbursing the relief fund because as per their record, no contribution was received from the petitioner. They are however ready to disburse the said amount from the current year onwards provided the petitioner pays the contribution amount.

4. Recording the said submission, the Writ Petition is dismissed. No costs.
