ORDER

This petition has been filed to direct the second respondent not to harass the petitioner and his family members under the guise of enquiry without due process of law. 2.When the matter is taken up for hearing, there is no representation for the petitioner. Even on the earlier occasion also, there was no representation for the petitioner. 3.On 27.07.2021, when the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that no complaint or enquiry is pending against the petitioner and based upon the representation made by the petitioner, enquiry in CSR No.332 of 2021 is undertaken.

4.Today (24.08.2021), the learned Additional Public Prosecutor would submit that the petitioner did not appear before the enquiry officer and co-operate with the enquiry. Enquiry also revealed that the petitioner is not residing in the address given in the representation. His house is found locked. https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.9974 of 2021 5.Since no complaint is pending against the petitioner and the petitioner did not co-operate for the enquiry, which was undertaken based on the representation given by him, question of harassment may not arise.

6.Recording the submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is dismissed.
