C-39R. To call for the records relating to the Judgment dt. 21.02.2025 made in Crl.A. No. 138 of 2024 on the file of the learned III Additional District and sessions Judge, Thanjavur at Pattukottai by confirming the conviction and sentence imposed in S.T.C.No.161 of 2022 on the file of the learned Judicial Magistrate, Fast Track Court, Pattukottai, Thanjavur District, dated 07.08.2023 and set aside the same as illegal.

ORDER

Today the matter came up for hearing under the caption "for being mentioned".

2. Paragraph No.10 shall be substituted by the following: "10. Accordingly, the Joint Compromise Memo dated 18.06.2025, is taken on file. The Criminal Revision Case is allowed in terms of the Joint Compromise Memo dated 18.06.2025. The conviction and sentence imposed upon the petitioner vide judgment dated 21.02.2025, in Crl.A.No.138 of 2024 on the file of the learned III Additional District Sessions Judge, Thanjavur @ Pattukkottai, confirming the conviction and sentence imposed by the judgment dated 07.08.2023 in S.T.C.No. 161 of 2022 on the file of the learned Judicial Magistrate, Fast Track https://www.mhc.tn.gov.in/judis

Court, Pattukottai, Thanjavur District, is set aside and the petitioner is acquitted of the offence under 138 of Negotiable Instruments Act, 1881. The petitioner is permitted to withdraw the amount deposited to the credit of S.T.C.No.161 of 2022 on the file of the learned Judicial Magistrate, Fast Track Court, Pattukottai, by following due procedure."

3. Registry is directed to carry out the necessary corrections in the order copy and issue fresh order copy.
