ORDER

This Criminal Original Petition has been filed seeking direction to transfer the investigation of the complaint preferred by the petitioner dated 06.02.2023 pending on the file of the 2nd respondent to any other investigating Authority within the time stipulated. 2.On the side of the petitioner, it is stated that the petitioner is the victim and the petitioner was attacked with iron rod and obtained treatment for a period of 10 days as inpatient. The petitioner sustained fracture injury. But the police officials failed to implead Section 326 IPC and prays suitable directions.

3.On the side of the prosecution, it is stated that originally the FIR was registered on 24.01.2023. Now on 16.04.2023, Section was altered and Section 326 IPC was included. The copy of the alternate report was also filed.

4.In view of the above said development, this criminal original petition is dismissed as infructuous.
