For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.58 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehend arrest at the hands of the respondent Police, for the offence punishable under sections 4(1-a), 4(1)(aaa), 14A of the Tamilnadu Prohibition Act, in Crime No.58 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 28.05.2022 at about 03.30 p.m., the defacto complainant/Sub-Inspector of Police along with police parties engaged in routine vehicle check-up, near Othakadai, a Maruthi Suzuki Omni Car bearing Regn.No.TN-59-CB-7673 came from Mandapam Salai to Aruppukkottai was intercepted by the police parties and it was found in possession of Liquor Bottles which were manufactured by Pondicherry Union Territory. Subsequently, all the procedures have been undertaken on the five persons and four accused persons have arrested on the spot. Hence, the complaint.

CRL OP(MD). No.10808 of 2022 3.During the course of investigation, it is revealed that the petitioner is a prime accused person and he only issued directions to the other accused persons to settle the liquor bottles to other persons.

4.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and a false case has been foisted against this petitioner.

5.The learned Government Advocate(Crl.side) appearing for the respondent police submitted that there are three previous cases pending against the petitioner and the offences are similar in nature.

6.Eventhouth the petitioner is ready to file an undertaking affidavit, considering the seriousness and gravity of the offence alleged as against the petitioner and also the fact that three previous cases are pending against this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 7.In the result, this Criminal Original Petition stands dismissed.
