ORDER
The present writ petition has been filed to direct the respondents to grant permission and police protection for conducting Chitirai festival to the Arulmigu Bhagavathiamman temple from 24.04.2025 to 02.05.2025 at Thokupatti, Karur District by considering the petitioner's representation dated 18.03.2025.
2. According to the petitioner, he is one the villagers of Thokupatti, Karur District and all the villagers have decided to conduct Chittirai festival to the Arulmigu Bhagavathiamman temple from 24.04.2025 to 02.05.2025. In this regard, they have sent representation to the respondents on 18.03.2025 but the same was not considered. Hence, this petition.
3.The learned Additional Public Prosecutor appearing for the respondents would submit that in the village there are two groups and the petitioner's group by avoiding the other group decided to conduct festival, therefore, the opposite group opposed to conduct festival. In 2/5
this regard, they have also conducted peace committee meeting. However, no settlement is arrived between the parties. The petitioner's group used to give communal colour to the festival and if they avoided the opposite group, law and order problem would arise. Hence, strongly oppose to allow this petition.
4.At this juncture, the learned counsel for the petitioner would submit that the petitioner's group is ready to conduct festival along with the opposite group and without any communal identity. 5.This Court had heard learned counsels appearing on both sides and perused the materials available on record. 6.Considering the nature of relief sought for by the petitioner and the undertaking of the petitioner that they will conduct the festival jointly along with the opposite group and without exhibiting any communal identity and the festival starts from today (ie., 24.04.2025), recording the submission of the learned Government Advocate (Crl.Side), this Court hereby directs the respondents to provide adequate 3/5
police protection to conduct Chitirai festival to the Arulmigu Bhagavathiamman temple from 24.04.2025 to 02.05.2025 at Thokupatti, Karur District, after ensuring the fact that the petitioner's group is conducting the festival jointly with the opposite group and without any communal identity.
7. With the above said observations and directions, this writ petition stands disposed of.
