ORDER
This writ petition challenging the proceedings bearing R.C.No. 2254241/2025/N2 dated 29.12.2025 rejecting the claim of the petitioner for including his name for promotion to the post of the Assistant Treasury Officer for the panel year 2011-2012.

A perusal of the impugned proceedings would disclose that the claim of the petitioner was negatived on the ground that the petitioner has suffered punishment through proceedings bearing Na.Ka.No.22809/Q2/2009 dated 06.09.2016 and the said punishment was accepted by the petitioner and therefore, the petitioner is not entitled for inclusion of his name for the panel Year 2011-2012. There is no dispute on factual aspects. The punishment that was imposed through proceeding punishment on 06.09.2016 was accepted by the petitioner and the same has become final. It is also not in dispute that the criminal proceedings that were initiated against the petitioner were pending beyond the date of 2/5
superannuation of the petitioner and the petitioner came to be acquitted only after he attained the age of superannuation.
3. Be that as it may, the claim of the petitioner is for inclusion of his name for the panel year 2011-2012 for promotion to the post of Assistant Treasury Officer. The petitioner attained the age of superannuation on 31.08.2013. For the reasons best known, the petitioner has not raised any claim for such promotion or inclusion of his name in the panel while he was in service or immediately after he retired from service or immediately after the petitioner was acquitted in the criminal proceedings on 24.09.2013. But such a claim is made for the first time by the petitioner only in the year 2025 by submitting a representation and thereafter, by approaching this Court for consideration of the said representation. Thus, the claim of the petitioner for promotion was made for the first time after elapse of more than 14 years in the year 2025. Therefore, on the ground of delay and laches also, the petitioner is not entitled to claim for inclusion of his name for the panel Year 2011-2012 for promotion to the post of Assistant Treasury Officer.

4. In the circumstances, this Court does not find any reason to entertain this writ petition at this length of time and accordingly, the same is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
