PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct respondents 1 to 4 to remove encroachments in and around the Bus Stand, Eral and also the Highways lands to an extent of about 7 Acres 77 Cents, in Survey Nos.71, 157, 158 and 162 and also lands in Survey No. 149/71, Valavallan Village, Srivaikundam Taluk, Thoothukudi District, based on the communication of the third respondent dated 31.05.2018 within a time frame as may be fixed by this Court. [Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted to direct respondents 1 to 4 to remove encroachments in and around the Bus Stand, Eral and also the Highway lands to an extent of about 7 Acres and 77 Cents in Survey Nos. 71, 157, 158 and 162 and also the lands in Survey No.149/71, Valavallan Village, Srivaikundam Taluk, Thoothukudi District. 2/4

2. The learned Government Pleader would submit that survey has been conducted in respect of S.Nos.71 and 149/71 and in respect of S.Nos.157, 158 and 162, the Authorities have to conduct survey and in the event of any encroachment, all appropriate actions will be initiated to evict the encroachers by following the procedures as contemplated under law.

3. In view of the above submission, the official respondents are directed to complete the survey and remove the encroachments, if any, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

4. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
