Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish the Contemnors/Respondents for contempt for willfully disobeying the order of this Court in WP(MD). No.23969 of 2025 dated 08.09.2025.

ORDER

The petitioner in the contempt is the 5th respondent in the writ petition. The writ petition was filed by one Pandimeenal for Writ of Mandamus directing the third respondent to issue cost assignment. The said Pandimeenal were ready and willing to pay the cost of the land.

2.This Court, after considering the same, directed the 1st and 2nd respondents, namely, the Commissioner of Revenue Administration and the District Collector to consider the Pandimeenal's representation and pass appropriate orders within a period of six months.

3.Now, the writ petitioner has filed the present contempt alleging disobedience. There is no direction to remove the encroachment. However, the same order was granted in the Hon'ble Division Bench in the earlier round of litigation. Based on the said direction, the respondents have already removed the encroachment. But the said Pandimeenal encroached the said place again. The petitioner has filed the subsequent writ petition which is pending. The cause of action of encroachment would arise before the Hon'ble Division Bench and not before this Court. Therefore, this Court is of the considered opinion that the present contempt petition will not lie. Hence, the contempt petition is dismissed. No costs.
